Fleet Seeker No Nonsense Terms:

Our Obligations and What We Will Provide:

G2data Communications Limited will supply, install and maintain the vehicle tracking unit for the term of the contract.

The contract includes a non-transferable license to use the Fleet Seeker vehicle tracking and fleet management application, hosting for up to 100MB of data storage per asset, data costs, mapping license, software upgrades and product warranty for the term of the contract.

Unless otherwise stated, mapping will cover Western Europe.  Mapping will normally be detailed down to street level but the detail and quality of mapping may vary dramatically depending on that made available by our mapping partners.  We reserve the right to change mapping partners during the term of the contract.

Unless stated otherwise in writing at time of purchase, we own all tracking unit hardware until the last payment of a contract is made.  We own the SIM card contained in the tracking unit at all times, even after the end of the contract term and on request must be given access and opportunity to inspect the integrity of any SIM within a reasonable time.

 

Changes to Service:

Service is defined as access to the features of the Fleet Seeker browser based vehicle tracking and fleet management application.

Features maybe changed, upgraded or withdrawn without notice.

 

Interruption to Service:

We do not guarantee our service is error free. 

Where through no fault of the customer, the service has been interrupted for more than 7 consecutive days, we will add that term free of charge to the end of the contract term. 

From time to time we may suspend access to the service or some feature(s) of it without notice in order to upgrade the service, carry out maintenance or repair faults.

We may block access to the service without notice if we suspect unauthorised access or any malicious or suspicious activity.  Examples might include suspected denial of service attacks or attempts to hack into our service.  We may block access from any IP address or groups of IP addresses or domains that we suspect may be unauthorised to access our service, or we suspect may interfere in any way with the operation of our service.

The service we provide is dependent on the provision of products and services supplied by numerous third party suppliers and service providers, including mobile phone networks, mapping, Internet service providers, telecommunications, electricity power suppliers, couriers and postal services.

In the event of a failure of our service, G2data Communications Limited is not liable for any loss of use, data, or profits, or business interruption however caused, including negligence or otherwise.

 

Evidence of Tampering to Tracking Unit:

Tracking units are installed with overt and covert anti-tamper measures.  Where we have been called out to a tracking unit that has failed to respond, we reserve the right to charge a £75/€95 call out fee where there is evidence of tampering to a tracking unit.

 

Evidence of Tampering or Misuse of SIM:

Tracking units contain a mobile phone SIM to enabled their communication via the GPRS network.  These SIMs are installed with anti-tamper stickers and/or other markings and may only be removed by an authorised representative of G2data Communications Limited.  Where there is evidence that the SIM has been removed and used outside the normal operation of the tracking unit, we reserve the right to charge for all voice calls, SMS messaging and any data charges that exceed what can be considered normal usage for our tracking unit.

 

Cancellation or Blocking of SIM:

We reserve the right to cancel or block any SIM without notice where we have reason to suspect it may not be used exclusively for the purpose of vehicle tracking.  This includes the blocking or cancellation of a SIM or batch of SIMs as a precautionary measure (for example where a theft is suspected).

 

Tracking Unit Failures:

The tracking unit is a complex mini-computer that like all computers can freeze up, or fail to respond as expected.  If such a problem cannot be diagnosed and rectified remotely, we will respond within a reasonable time, subject to the vehicle being made available to our engineers. 

G2data Communications Limited is not liable for any down time of a vehicle in order to conduct a service call.  At least 90 uninterrupted minutes should be provided to our engineer per unit in order for them to inspect/repair/replacement a failed unit.  We do not guarantee all faults will be diagnosed and fixed on the first call out.  Further call outs may be required in order to rectify a fault. 

Access to vehicles requiring tracking unit installation or service calls should be provided within Northern Ireland or the Republic of Ireland during business hours (Monday to Friday, 9am to 5pm) unless otherwise agreed by us.

 

Payment Terms:

The customer agrees to pay for the service for the term of the contract.  In the event of non-payment the service will be withdrawn and appropriate proceedings taken to recover monies owed.

Unless otherwise notified by us, once a contract term is completed, the service will automatically renew itself and continue to be provided if payment for the service continues. 

If payment is withdrawn by a customer after a contract term is completed the service will be stopped and the customer may be required to sign up to a new contract and/or contract term in order to re-start the service.

We reserve the right to alter the terms of the contract once a contract term is completed and may require that a new contract term be agreed by the customer.

Should the service be withdrawn for non-payment OR where a contract has been allowed to lapse, a call out fee of £75/€95 may be charged to the customer to re-activate each tracking unit.

Refunds will only be given in exceptional circumstances at the discretion of the Management.

 

Customer’s Responsibilities:

The customer agrees take care not to disclose or share the Fleet Seeker username or password provided to them.

The customer agrees not to use the service for anything illegal.

The customer agrees to pay for the service on the due date.

The customer may not transfer this agreement to any third party.
